These Terms and Conditions ("Terms") govern your access to and use of summitbullion.io and any related services (the "Site") operated by Summit Bullion Incorporated, a Delaware corporation ("Summit," "we," "us," or "our").
By placing an order, creating an account, or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms contain important provisions that limit our liability and make you responsible for market loss on cancelled or unpaid orders. Please read Sections 8, 9, 20, and 21 carefully.
To use the Site and place orders you must:
We may refuse service, cancel orders, or terminate accounts at our discretion, including where we suspect fraud, sanctions exposure, or violation of these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at contact@summitbullion.io of any unauthorized use.
We may suspend or terminate an account at any time, with or without notice, where we believe it is being used in violation of these Terms or applicable law.
Summit maintains an anti-money-laundering and identity verification program. Verification is performed by our third-party provider.
Verification is tiered and limits are cumulative, applied across your total transaction activity rather than per transaction:

You may be required to complete a higher verification tier before an order can be accepted. Orders that would exceed your current tier limit will be held until verification is completed.
Structuring transactions to remain below any threshold is prohibited and may result in account termination and reporting to appropriate authorities.
We screen customers against sanctions and politically exposed persons lists before any transaction is permitted, and periodically thereafter.
Summit sells investment-grade precious metals. Product descriptions, specifications, weights, purities, and images are provided for reference and may vary. Where a product is listed as "brand varies," "design varies," or similar, we select from available inventory meeting the stated specification.
We make no representation that any product will appreciate in value or is suitable for any particular purpose.
Availability is not guaranteed. Product listings do not constitute an offer to sell. We may correct pricing or availability errors at any time, including after an order is submitted, and may cancel affected orders with a full refund.
Prices are based on live precious metals markets and change continuously. The price displayed at any moment reflects then-current market conditions plus our premium and applicable fees.
Prices shown are in U.S. dollars and exclude shipping, insurance, and applicable taxes unless expressly stated.
Your price is locked at the moment your order is confirmed, subject to Section 7. Subsequent market movement does not entitle you to a price adjustment, nor does it obligate you to pay more.
We reserve the right to correct pricing errors, including obvious errors resulting from data feed failures, and to cancel affected orders with a full refund.
Submitting an order constitutes an offer to purchase. A binding contract is formed when we confirm your order, at which point the price is locked and the transaction is final subject to these Terms.
Order confirmation is sent by email. If you do not receive confirmation, contact us before assuming an order was not placed.
We may decline, limit, or cancel any order for any reason, including inventory constraints, pricing errors, suspected fraud, verification failure, or exposure limits.
This section is important. Precious metals prices move continuously, and we purchase metal to fill your order at the price locked when your order was confirmed. If you do not pay, we bear the market risk.
Payment is due at the time of order unless we agree otherwise in writing. Accepted methods are listed at checkout and may include credit and debit card, ACH bank transfer, wire transfer, and digital assets.
Orders are not released for fulfillment until payment has been received and cleared. Clearing times vary by payment method.
All confirmed orders are binding. You may request cancellation, and we may grant it at our discretion, subject to Section 8.3.
If you cancel a confirmed order, fail to remit payment, or your payment is returned, reversed, or otherwise fails, you are responsible for any market loss.
Market loss means the amount, if any, by which the price of the metal at the time we liquidate the position is lower than the price locked on your order, calculated on the full quantity ordered.
If the market has moved in our favor, no market gain is credited to you.
We may charge market loss to your payment method on file, offset it against any refund due, or pursue collection.
Initiating a chargeback on a delivered order without first contacting us is a breach of these Terms. We will contest such chargebacks and may pursue recovery of the merchandise value, fees, and costs.
Read this carefully. It differs materially from ordinary consumer ecommerce.
All sales are final. Because precious metals prices fluctuate continuously and we cannot resell returned product at the price paid, we do not accept returns or exchanges, and we do not issue refunds, except:
If we accept a return in our discretion outside these circumstances, it will be subject to market loss under Section 8.3 and a restocking fee.
We ship within the United States only. We do not currently ship internationally.
FedEx and UPS do not deliver to P.O. Boxes. Orders addressed to a P.O. Box will ship via USPS where the order qualifies for that service.
Shipping charges are calculated at checkout. Estimated delivery timeframes are estimates only and are not guaranteed.
Certain shipments require an adult signature. If a signature is required and delivery cannot be completed, the carrier's procedures apply. Packages returned to us as undeliverable may be subject to reshipment charges.
Shipments are insured in transit as described in Section 12.
We are not responsible for delays caused by carriers, weather, customs, or events outside our reasonable control.
Orders are fulfilled from our own inventory or through our supply partners. Fulfillment timeframes vary with market conditions and supplier availability, and may be extended during periods of high demand.
If an order will be materially delayed, we will notify you. You may request cancellation of a materially delayed order, and where the delay is attributable to us, cancellation will not incur market loss.
Shipments are insured in transit until delivery to the address you provide.
Risk of loss passes to you upon delivery, or upon the carrier's record of delivery where no signature is required. Where a signature is required, risk passes upon signature.
If you authorize the carrier to leave a package without signature, or redirect a shipment after dispatch, you assume all risk of loss and insurance coverage may be void.
Inspect your shipment immediately upon delivery.
Claims for damage, shortage, or product mismatch must be reported to contact@summitbullion.io within 2 business days of delivery, with photographs of the packaging and contents, and the packaging retained.
This window is deliberately shorter than our supplier's 3-business-day deadline so that claims can be relayed in time. It is not a limitation for its own sake.
Claims reported after this period may be denied. Failure to retain packaging may void an insurance claim.
Applicable sales and use taxes are calculated at checkout based on your shipping address. Precious metals are exempt from sales tax in many states, and exemptions vary by state, product type, purity, and order value.
You are responsible for all taxes arising from your purchase, including any use tax due in your jurisdiction where we do not collect it, and for all income and capital gains tax consequences of your transactions.
We do not provide tax advice. Consult a qualified tax professional.
Summit is subject to federal reporting requirements including, where applicable:
We will comply with all such obligations. We may request additional information from you to satisfy them, and may decline or unwind transactions where required information is not provided.
Summit is a precious metals dealer. We are not a broker-dealer, investment adviser, financial planner, or fiduciary.
Nothing on the Site, including market commentary, spot prices, charts, educational content, or product descriptions, constitutes investment, legal, or tax advice, or a recommendation to buy, sell, or hold any asset.
Precious metals prices fluctuate and may decline. You may lose money. Past performance does not indicate future results. You are solely responsible for your investment decisions.
You may not:
The Site, including its content, design, text, graphics, logos, and software, is owned by Summit or its licensors and protected by intellectual property laws. Product images and descriptions may be provided by manufacturers, mints, or suppliers and remain their property.
You are granted a limited, revocable, non-exclusive, non-transferable license to access the Site for personal, non-commercial use.
The Site integrates third-party services including payment processing, identity verification, shipping carriers, and email delivery. Your use of those services is subject to their own terms and privacy policies. We are not responsible for their acts or omissions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT PRICING OR MARKET DATA IS ACCURATE OR CURRENT, OR THAT ANY PRODUCT WILL RETAIN OR INCREASE IN VALUE.
Some jurisdictions do not permit certain exclusions; those exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUMMIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITY, OR MARKET LOSS SUSTAINED BY YOU, ARISING FROM OR RELATING TO THE SITE OR ANY TRANSACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
22.1 Informal resolution first. Before commencing any proceeding, you agree to contact us at contact@summitbullion.io and attempt in good faith to resolve the dispute for 30 days.
22.2 Venue. If informal resolution fails, any dispute arising from or relating to these Terms or any transaction shall be brought exclusively in the state or federal courts located in Duval County, Florida. You and Summit consent to the personal jurisdiction of those courts.
22.3 Small claims. Either party may bring an individual claim in small claims court where jurisdictional requirements are met.
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Venue is as set out in Section 22.
Changes. We may modify these Terms by posting a revised version with an updated date. Material changes take effect 30 days after posting. Continued use constitutes acceptance. The Terms in effect when your order is confirmed govern that order.
Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Summit.
Severability. If any provision is unenforceable, the remainder continues in full force.
No waiver. Our failure to enforce any provision is not a waiver.
Assignment. You may not assign these Terms. We may assign freely.
Force majeure. We are not liable for failure to perform due to causes beyond our reasonable control.
Survival. Sections 8, 9, 14, 15, 16, 18, 20, 21, 22, 23, and 24 survive termination.
